Arxscale LLC (“Arxscale,” “we,” “our,” or “us”), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website, contact us, or interact with websites, forms, CRM, email, SMS, review-management, appointment-booking, chat, voice, and automation services that we provide to business clients.
1. Scope and Our Role
We provide digital marketing, website, reputation-management, CRM, communications, and automation services to businesses. In some situations, we collect information for our own business purposes. In others, we process information on behalf of a client that determines why and how the information is used. If you interact with one of our clients, that client's privacy notice may also apply.
2. Information We Collect
· Contact and business information, such as name, email address, telephone number, business name, job title, and service or mailing address.
· Information submitted through forms, appointment requests, chats, emails, SMS messages, calls, voicemail, or support communications.
· Client-provided customer and lead data, such as contact lists, lead records, appointment information, communication history, and review-request information. Voice and AI interaction data. Where enabled, calls or voice interactions may be recorded, transcribed, summarized, analyzed, routed, or processed by automated or artificial-intelligence systems, subject to applicable notice and consent requirements.
· Technical and usage information, such as IP address, browser or device information, referring pages, pages visited, timestamps, cookies, pixels, analytics, and diagnostic information. Information received from connected services that a client or user authorizes, such as CRM, calendar, messaging, telephony, payment, analytics, social-media, advertising, review, or business-profile platforms.
3. How We Use Information
· Provide, configure, maintain, support, secure, and improve our services.
· Operate websites, forms, CRM workflows, review-request systems, email and SMS automations, appointment scheduling, lead routing, reporting, and reputation-management services.
· Enable AI-assisted or automated chat, SMS, voice, receptionist, lead-response, after-hours response, qualification, routing, appointment-booking, and follow-up functions.
· Communicate with clients, prospects, users, and, when acting for a client, the client’s customers or leads.
· Prevent abuse, troubleshoot problems, protect accounts and systems, comply with law, enforce agreements, and establish or defend legal claims.
4. SMS, Email, and Communications
We may send or facilitate SMS, email, and other electronic communications for ourselves or on behalf of clients. Depending on the communication, messages may include appointment confirmations and reminders, responses to inquiries, service or account updates, review or feedback requests, referral-related communications, and, where separately authorized, marketing or promotional messages. Message frequency may vary. Message and data rates may apply. Where applicable, reply STOP to opt out of SMS messages and HELP for assistance. Marketing emails will include an unsubscribe method when required.
Clients are responsible for obtaining and maintaining the notices, permissions, consents, and other lawful bases required for communications they instruct us to send or facilitate, and for maintaining evidence sufficient to substantiate those permissions and consents. Possession of a telephone number in a CRM, accounting system, spreadsheet, customer database, or similar source does not by itself establish consent to receive SMS or marketing communications. Where different categories of communications require different consent, including marketing and non-marketing messages, the applicable consent must be obtained and honored separately. Clients must promptly honor opt-out and revocation requests and must not direct us to message persons whose consent is absent, insufficient, revoked, or otherwise legally unavailable. We may require evidence of consent, decline to activate historical or imported contact lists with unknown or undocumented consent, or suspend activity that appears unlawful, abusive, deceptive, or inconsistent with carrier, platform, TCPA, A2P/10DLC, or other applicable requirements. A2P/10DLC registration or carrier approval does not itself establish a recipient's consent.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
5. AI and Automated Interactions
Some services use artificial intelligence, machine learning, conversational agents, or other automated technologies to generate or suggest responses, summarize conversations, classify or route leads, collect information, answer common questions, communicate by chat or SMS, or schedule appointments. AI receptionist services may answer inbound calls, interact with callers, collect information, route inquiries, schedule appointments, trigger requested SMS or email confirmations, and notify the applicable business client. Automated outputs may be incomplete, delayed, or inaccurate. These systems are not emergency services or substitutes for licensed professional judgment. Clients are responsible for providing accurate source information and maintaining appropriate human oversight and escalation procedures.
6. Voice Calls, Recording, and Transcription
Where enabled, calls or voice interactions may be recorded, transcribed, summarized, analyzed, or processed to provide requested services, and resulting recordings, transcripts, summaries, appointment details, or related information may be made available to the applicable business client. Callers may receive an automated notice that they are interacting with an AI-powered system and/or that the interaction may be recorded or transcribed. Recording, interception, AI, biometric, privacy, and telemarketing laws vary by jurisdiction, and these functions are used subject to applicable notice and consent requirements.
7. Cookies and Analytics
Our website and services may now or in the future use cookies, pixels, tags, local storage, analytics, conversion measurement, advertising or retargeting technologies, and similar tools to operate the service, remember preferences, understand traffic and performance, measure campaigns, prevent fraud, and improve marketing. The technologies actually used may change as our services evolve. Where required by applicable law, we will provide required notices, choices, or consent mechanisms for non-essential technologies.
8. How We Disclose Information
· To the client on whose behalf information was collected or processed.
· To service providers and subprocessors that support hosting, CRM, telephony, messaging, email, AI, analytics, security, scheduling, payments, support, reputation management, and other operational functions.
· To connected third-party services at the direction of a client or user.
· To professional advisers or in connection with a merger, acquisition, financing, reorganization, or sale of assets.
· To governmental authorities, courts, law enforcement, or others when required by law or reasonably necessary to protect rights, safety, security, or prevent fraud or abuse.
We do not sell personal information in the ordinary meaning of selling data for money. If our activities are treated as a “sale” or “sharing” under an applicable privacy law, we will provide legally required rights and opt-out mechanisms.
9. Client-Provided Data
Clients may provide us with customer, prospect, employee, or other third-party data. By doing so, the client represents that it has authority and a lawful basis to provide the information and instruct us to process it. We process client-provided data to deliver and secure services, follow documented client instructions, and meet legal obligations.
10. Data Retention and Security
We retain personal information for as long as reasonably necessary to provide services, maintain business and security records, resolve disputes, enforce agreements, and comply with legal obligations. Retention periods may vary by data type, client instructions, backup cycles, contractual commitments, and legal requirements.
We use reasonable administrative, technical, and organizational safeguards designed to protect information. No Internet, telecommunications, storage, or AI system can be guaranteed to be completely secure.
11. Privacy Rights
Depending on where you live and whether applicable legal thresholds are met, you may have rights to access, correct, delete, or obtain a copy of certain personal information, and to opt out of certain sales, sharing, targeted advertising, or profiling. You may also have a right to appeal certain privacy-request decisions. We will honor applicable rights as required by law and may verify identity or authority before completing a request. When we process data solely for a client, we may direct the request to that client or assist the client in responding.
12. Children
Our services are directed to businesses and are not intended for children under 13. We do not knowingly collect personal information directly from children under 13 through our own business website.
13. Third-Party Services
Our services may integrate with or link to third-party platforms. Those third parties operate under their own terms and privacy practices. We are not responsible for independent third-party privacy practices, outages, changes, or acts outside our reasonable control.
14. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the revised version and update the effective date. Where required by law, we will provide additional notice before material changes take effect.
